Should Consider a Prepaid Legal Plan
- The Castle Law went into effect Sept. 1st 2007. You should assume, even with the Castle Law in place, if you ever have to use deadly force, an attempt will be made by the survivor or their relatives to sue you in civil court, regardless if you are found guilty of any criminal act. At present, it is almost a guarantee you will be sued civilly.
- Anyone can sue anyone and having an Affirmative Defense will aid you in responding to a law suit. You will need an attorney to respond on your behalf, citing the statues of the Castle Law, whereby evidencing you are not liable.
- You will also need the attorney to file a judgment on your behalf to recoup attorney fees arising from the frivolous law suit brought against you.
- After the use of deadly force in which someone is injured or killed, the shooter will go before a Grand Jury. The Grand Jury will find a "true bill" or a "no bill". "True bill" means there will be a trial. This is criminal law and may result in criminal charges, jail time and/or fines.
- Grand Jury proceedings can cost you from $5,000 to $25,000 in Attorney Fees. Most attorneys charge a flat rate for this service.

You have 24/7 access to an attorney in emergency situations, if you are ever arrested, detained or questioned. In any use of Deadly Force, you will need to talk to an attorney immediately to find out what your rights are and what you need to say or not to say and what your next step should be.
(2) Grand Jury Proceedings; We will retain an Attorney for you who will agree to work on an hourly basis rather than a Flat Rate as described above. You will also receive at least a $25% discount off their standard hourly rate. (The average standard hourly rate is $250 p/h) This alone will save you thousands of dollars. (3) Trial Defense Services. If you or your spouse are ever sued in a Civil Suit or a work related Criminal Suit, your first year of membership, you will receive 75 hours of attorney time with 17.5 hours for pre-trial and the remainder for trial time. Each year you will receive additional hours, capping off the 5th year with 335 hours of attorney time of which 39.5 hours are for pre-trial. Conversely, having this protection would afford you the equivalent of over $80,000 in a litigation account at $250 per hour for a criminal attorney to represent you your 5th year.

CIVIL LIABILITY
Regardless of whether the shooting is totally justified and no criminal charges are filed, you still must face your assailant’s grieving family or the injured assailant, represented by an attorney in a CIVIL ACTION against you. If You Have Already Filed A Civil Action Against Your Assailant, You May Be In A Slightly Better Position To Overcome His Suit Or Negotiate A Mutual Withdraw of Litigation. HOWEVER, civil lawsuits can be filed for any reason, with or without merit. In order for an attorney to file a civil case against you, he needs to see Damages (a dead or seriously injured bread winner and family man) Liability (you pulled the trigger) and Money (your house, savings account, personal property, children’s college fund) to recover for his client and to pay his fees. Many of these cases are handled on a contingency fee basis which the attorney gets paid after he successfully settles or wins the case. If he doesn’t win, the client pays nothing or minor filing fees.
The bottom line FOR YOU in defending against a civil case is that your attorney doesn’t stand to win any money, so you pay him hundreds of dollars per hour to represent you in the civil case – Win, Lose, or Draw. Understand that the civil case is MORE DIFFICULT for you to defend if you plea bargain to accept a lesser conviction or are found guilty of a crime.
Liability insurance policies such as Homeowners Insurance and Personal Liability Umbrellas have clauses that will not cover you if you injure someone during a criminal act.
Even after a totally justifiable shooting, you can expect any, or all of the following to occur:
- You may be arrested and in jail for 48 hours.
- Newspapers may report on the front page that you killed a man and were arrested for your actions.
- You may have to post bail in at least the amount of $10,000.00
- You may immediately spend $10,000.00 to retain an attorney.
- You may immediately spend $5,000.00 to retain legal experts and private investigators
- Total legal cost may run a MINIMUM of $50,000.00
- You may face months to years of court appearances and follow up stories and photos in the newspaper.
- The criminal court case may immediately be followed by a civil court case.
- You may change your phone number in an attempt to avoid harassing calls from the public
- You may remove your children from school because of other children calling you a murderer.
- You may lose friends and business associates who do not want to associate with you.
- You may be looked at forever as “different” now that you have taken a life.
Remember “Gun fighting is risky business.” You risk everything and you don’t win anything. You just keep what you have. You now see that even when you win, you still lose to a great extent.
